BANGKOK – Thailand’s tougher action against nominee companies won’t end foreign demand for homes, villas, or condos. However, the market is changing as authorities target hidden foreign control of land, rather than treating every foreign-owned property as illegal.

The legal distinction matters. Foreigners can still own a condominium in their own name, provided the project stays within Thailand’s 49% foreign ownership quota, while nominee structures use Thai shareholders as proxies to control land, villas, or land-owning companies. The rules for foreign condo ownership are different from arrangements designed to bypass Thailand’s restrictions on foreign land ownership.

He stressed that the group was not generalising an entire nationality and called on relevant agencies to take firm action against individuals who break Thai law.

När jag flyttade till Samui 2004 var det en enorm mäklarboom här. Det ploppade upp nya real estate-firmor hela tiden. Flera om mina vänner, både thai och faranger, höll på med att kränga mark och boenden. Vissa som ”hobby” och andra på heltid. Även min fru har jobbat en del med det. Redan på den tiden var det klart för de med lite koll att det var illegalt att driva företag och köpa land via nominees/bulvaner. Så det är absolut inget nytt fenomen. Runt 2007-2010 började många av mäklarna försvinna. Det var helt enkelt för många som jagade procent på mark- och villaaffärer och marknaden var mättad. Alla hoppades på att få sina tre procent på en enorm markdeal, men många sålde i princip ingenting.

Och nu,15-20 år senare, är min spontana tanke att mäklarmarknaden gentemot utlänningar är stendöd. Hur tusan skall mäklarna hitta köpare annat än bland thai?! Många pågående projekt kommer aldrig att slutföras. De kommer förbli ”gravplatser” med betongskelett som sakta vittrar bort av väder och vind.

Hehe, om de hade demonstrerat för ett år sedan hade jag förstått det bättre. Det de efterlyser är väl exakt det som pågår nu?!

Jaja, samtidigt förstår jag dem. Det var inte så klyftigt av dessa israeler mfl (även på Phangan) som skränat om hur det "tagit över Thailand". Som nam na.
 
Jag gissar/tror/hoppas inte de som gör det enligt lagen (Section 540 — Civil and Commercial Code) kommer få problem.

De som man nu verkar fokusera på är företag som leasar mark med hus som man sedan hyr ut (eller rentav försöker ”sälja”) till andra utlänningar.

Men vi får väl se…
Givetvis är det fel att leasa ut något du inte äger.
Men vad kan hända de som subleasar från en utlänning med nominees om det är registrerat på landoffice?
