Thailand’s nominee crackdown intensifies: 2,000 firms in Hua Hin targeted​

More than 2,000 companies in Hua Hin with foreign investment are set to face closer scrutiny as Thai authorities expand a national investigation into suspected nominee business structures in major tourism destinations.

The Department of Business Development (DBD), under the Ministry of Commerce, has joined forces with the Department of Special Investigation (DSI) to investigate nominee business structures in major tourism destinations. The Anti-Money Laundering Office (AMLO) is also preparing to classify nominee offences as predicate offences under money laundering law, which would allow authorities to examine financial trails and seize assets linked to wrongdoing.

The operation began with Koh Phangan and Koh Samui in Surat Thani, where officials scanned 11,426 juristic persons involving foreign participation. Those companies will be classified according to the likelihood that they are nominee businesses, from high to medium and low risk, before inspections begin.

Officials said the investigation will now expand to other key tourism areas, including Phuket, Krabi, Phang Nga, Pattaya and Hua Hin.

In Hua Hin district, data from the DBD shows there are 4,162 limited companies in total. Of these, 2,081 have foreign joint investment, accounting for 51.24% of all limited companies in the district.

The figures show 35 companies in Hua Hin have foreign shareholders holding 50% or more of shares, while 2,046 companies have foreign shareholdings of between 0.01% and 49.99%.

The top foreign shareholder nationalities recorded in Hua Hin are British, with 355 companies, followed by Swedish investors with 231 companies, French investors with 174, German investors with 128 and Norwegian investors with 125.

Other nationalities in the top 10 include Chinese investors with 101 companies, Russian investors with 89, Danish investors with 82, Swiss investors with 77 and American investors with 76.

DBD Director-General Poonpong Naiyanapakorn said the department had discussed cooperation with the DSI after finding that some foreign-linked businesses in major tourist destinations may have characteristics of nominee operations.

Nominee structures typically involve Thai citizens holding shares on paper while a foreign investor retains actual financial or operational control. Such arrangements can be used to bypass restrictions under Thai law, including limits on foreign ownership in certain sectors and prohibitions on foreign land ownership.

Mr Poonpong said that where public complaints clearly indicate nominee behaviour, inspection teams would be sent immediately. The DBD would also work with other agencies depending on the nature of the suspected offence, including tourism, labour and tax authorities.

Authorities have already inspected suspected nominee companies on Koh Phangan, including an accounting office where the owner was reportedly listed as a shareholder in 66 companies. Officials also found buildings and residences used as registered addresses for 89 companies.

In Koh Samui, information on 34 companies involved in real estate and tourism, with combined assets exceeding 100 million baht, has been sent to AMLO for financial investigation.

The DBD is also in talks with the Thai Bankers’ Association on tighter checks to verify the source of funds used by Thai shareholders in companies involving foreign investors.

Officials said earlier measures introduced this year had already reduced nominee company registrations. Requirements introduced on 1 January, including stricter financial evidence, reduced registrations by 60%, while further rules introduced on 1 April, requiring confirmation that shareholders had genuinely invested and paid for their shares, reduced registrations by 75%.

Police Major Yutthana Phraedam, Director-General of the DSI, said the agency had proposed that nominee cases be classified as special cases, allowing investigators to examine them in greater depth.

Police Raid 32 Suspected Nominee Firms Holding Land Worth 150 Million Baht on Koh Phangan​

On May 13th, 2026, at 9:00 a.m., Deputy National Police Chief Pol. Gen. Samran Nualma, together with Pol. Gen. Noppasil Poolsawas, led a sweeping operation against suspected nominee companies on Koh Phangan. Nearly 300 officers from specialized task forces, including the Transnational Crime Suppression Center, Metropolitan Police Bureau, Crime Suppression Division, Immigration Police, Provincial Police Region 8, and local police units from Surat Thani and Krabi, were deployed to execute simultaneous raids across 32 targeted sites.​

The coordinated crackdown, dubbed Operation Nominee Takedown, focused on companies allegedly established to allow foreign nationals to illegally hold land and conduct business by using Thai citizens as proxy shareholders. Authorities searched five law firms and consultancy offices, along with 27 companies reported to hold 37 land plots valued at approximately 150 million baht.

In addition to the raids, police sought to apprehend four suspects linked to nominee operations, three Thai nationals and one foreigner, on charges of violating laws governing foreign business ownership and landholding.

During the searches, officers seized extensive evidence, including corporate documents, shareholder meeting records, land title deeds, purchase and lease agreements, management contracts, and financial records such as bank accounts and international transfer documents. Digital evidence, including computers and electronic data storage devices, was also confiscated for further investigation.

On topic: Bra att de tar tag i kriminell skit. Hoppas bara att de får fortsätta styra upp detta med en riktig genomgång av visum etc utan att svenska fattigpensionärer ska grina över att de inte kan stanna i evighet med visaruns längre :thumbsup:

Nja, ärligt talat så bryr jag mig inte, jag är en j-vel på att scrolla förbi det som jag tycker är ointressant. Mitt inlägg var ett försök att ironisera över dom som i tid och otid och med hånfulla ordalag hånar dom eller rättare han som ofta lägger in länkar utan kommentarer men det misslyckades jag tydligen helt med.Nåja, inte mitt första misslyckande i livet och helt säkert inte mitt sista heller.

AN ONGOING crackdown on nominees in tourist areas revealed that over 50,000 Thais have assumed this role on behalf of foreigners with further investigation and legal proceedings continuing, Naewna newspaper said today (May 18).

Mr. Poonpong Naiyanapakorn, director-general of the Department of Business Development, said Prime Minister Anutin Charnvirakul had assigned his agency to carry out the crackdown on the use of Thai nationals as nominees at tourist destinations during his visit to Koh Phangan on May 13.

Investigation uncovered the following details:

+ Koh Phangan: 4,761 limited liability companies, with foreign shareholders involved in 3,213 of them, 25 hold over 50% shares while 3,188 hold 0.01-49.99% shares. Top five nationalities are Israel, France, UK, Russia and Germany,

+ Koh Samui: 12,050 limited liability companies, with foreign shareholders involved in 8,213 of them, 53 hold over 50% shares while 8,160 hold 0.01-49.99% shares. Top five nationalities are France, UK, Russia, China and Israel

+ Phuket: 29,646 limited liability companies, with foreign shareholders involved in 11,626 of them, 239 hold over 50% shares while 11,387 hold 0.01-49.99% shares. Top five nationalities are Russia, China, UK, France and Australia

+ Phang Nga: 1,685 limited liability companies, with foreign shareholders involved in 346 of them, 12 hold over 50% shares while 334 hold 0.01-49.99% shares. The top five nationalities are Germany, UK, Sweden, France, US.

+ Krabi: 3,587 limited liability companies, with foreign shareholders involved in 749 of them, 13 hold over 50% shares while 736 hold 0.01-49.99% shares. Top five nationalities are UK, Sweden, France, US and Italy

+ Bang Lamung district (Pattaya): 33,314 limited liability companies, with foreign shareholders involved in 19,910 of them, 685 hold over 50% shares while 19,225 hold 0.01-49.99% shares. Top five nationalities are China, UK, Russia, India and Germany

+ Hua Hin: 4,061 limited liability companies, with foreign shareholders involved in 2,081 of them, 35 hold over 50% shares while 2,046 hold 0.01-49.99% shares. The top five nationalities are UK, Sweden, France, Germany and Norway.

+ Pai district: 139 limited liability companies, foreign shareholders involved in 50 of them, 2 hold over 50% shares while 48 hold 0.01-49.99% shares. The top five nationalities are UK, US, Israel, Germany and the Netherlands.

The department is expediting investigation into groups suspected of using nominees, such as companies with the highest legally defined proportion of foreign shareholding and granting foreigners the right to be directors with signing authority and Thais holding shares or serving as directors of multiple companies in an unusual manner. This could mean violatingForeign Business Act B.E. 2542, Sections 36 and 37, which is punishable by imprisonment of up to 3 years and a fine of 300,000 to 1,000,000 baht.

The Department will continue to cooperate with all agencies in seriously cracking down on nominee businesses to create fairness for Thai entrepreneurs, prevent the concealment of asset ownership, and maintain confidence in the country’s economic and investment system.

As the agency responsible for company registration, the department has also tightened registration procedures this year.
